Ordinance Amending the Official Zoning Maps of the City of Wilmington to Rezone Property Located at 110 Dawson Street from R-3, Medium-High-Density Mixed Residential District to UMX, Urban Mixed Use District (Z-5-124)

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, NCGS ??160D-102, 160D-108(d), 160D-603, and 160D-702 authorize local governments to change or modify zoning boundaries within their jurisdiction; and,
WHEREAS, the amendment set out below is made in accordance with NCGS ?160D-60,1 and Article 7, Divisions 1, and 2, of the City of Wilmington Land Development Code.
THEREFORE, BE IT ORDAINED:
SECTION 1: The official zoning maps of the City of Wilmington are hereby amended by removing the hereinafter described property, located at 110 Dawson Street, from the present R-3, Medium-High-Density Mixed Residential District, and putting it in the UMX, Urban Mixed Use District classification, said property being more particularly described as follows:
Commencing at the south western right of way intersection of Dawson and 2nd Street as recorded by Map Book 11, Page 11 of the New Hanover County Registry along and with the southern right of way of Dawson Street South 83 Degrees 51 Minutes 46 Seconds West a distance of 118.00 feet to a point, being the POINT OF BEGINNING, thence leaving the right of way of Dawson Street South 6 Degrees 8 Minutes 14 Seconds East a distance of 66.00 feet to a point, thence South 83 Degrees 51 Minutes 46 Seconds West a distance of 38.00 feet to a point thence, North 6 Degrees 8 Minutes 14 Seconds West a distance of 66.00 feet to a point at the southern right of way of Dawson Street, thence along and with the southern right of way of Dawson Street North 83 Degrees 51 Minutes 46 Seconds East a distance of 38.00 feet to the POINT OF BEGINNING; Containing 0.058 acres, more or less.
SECTION 2: The City is authorized to change the zoning maps on file in the office of the City Clerk, so as to make them comply with this ordinance...
