Resolution Conditionally Releasing Public Drainage Easement at 821 South College Road

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, The City of Wilmington was granted a general utility easement in December 1992, recorded at Deed Book 1636, Pages 1920-1926.
WHEREAS, The applicant (Bella Vista Development Group, LLC on behalf of the property owner 821 South College, LLC) is proposing to relocate drainage improvements to the public right-of-way and has requested release of the easement to accommodate their proposed development (the Paseo Mixed Use project).
WHEREAS, once the drainage facilities are relocated, City staff has determined the easement requested for release will not be necessary.
THEREFORE, BE IT RESOLVED:
THAT, the City of Wilmington hereby authorizes release of the easement as shown on Exhibit A attached to this resolution, conditional upon relocation of the drainage facilities. The City Manager is authorized to release the easement upon relocation of the drainage facilities and final inspection by City staff.
