Resolution Authorizing the City Manager to Amend the City’s Lease with Smith Turf & Irrigation LLC, to Replace two (2) Mowers at Inland Greens Golf Course [Budget Impact $104,866 - Parks and Recreation Operating Budget]

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, The City began leasing mowers from Smith Turf & Irrigation LLC (“Smith Turf”), beginning in 2017 with a 60-month term, for Inland Greens Par 3 Golf Course which expired in 2022; and,
WHEREAS, periodic equipment replacement is needed to sustain high quality greens; and,
WHEREAS, due to supply chain shortages, delivery of new equipment was delayed, with staff extending the original lease and pricing until equipment was available; and,
WHEREAS, the existing two (2) leased mowers will be returned to Smith Turf and new replacement mowers with accessories are anticipated to be delivered in October 2024; and,
WHEREAS, N.C.G.S. §143-129(e)(9) provides an exception to the procedures for letting public contracts for contracts established by the State or any agency of the State as long as the contractor is willing to extend to the City the same or more favorable prices, terms, and conditions as contained in the State contract, and this lease would be through North Carolina State contract number 2210B; and,
WHEREAS, the amended terms of the lease will be from October 16, 2024, through October 15, 2029, with monthly payments of $1,743.60, which totals $104,616 over the term of the lease, plus a $250 document fee due with the first payment.
THEREFORE, BE IT RESOLVED:
THAT, the procurement of the equipment pursuant to N.C.G.S. 143-129(e)(9) is authorized and appropriate.
THAT, the City Manager is hereby authorized to amend its agreement with Smith Turf & Irrigation LLC, for the lease of two mowers with accessories, with a term from October 16, 2024, through October 15, 2029.
THAT, this agreement is subject to adoption of future fiscal year budgets.
