Resolution Conditionally Releasing Drainage Easements within RiverLights Single Family, Phase VII, Section I

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, roadway and drainage facilities were constructed by NNP IV-Cape Fear River, LLC, in conjunction with the River Road realignment in 2015; and,
WHEREAS, easements for drainage facilities adjacent to the River Road right-of-way were originally recorded at Map Book 61, Page 201 with the New Hanover County Register of Deeds, and officially accepted by City Council on April 5th, 2016; and,
WHEREAS, the applicant proposed relocation of drainage facilities, and has requested release of the remaining portion of the easements in these areas; and,
WHEREAS, once the facilities are relocated, staff has determined the portion of the easements requested for release will not be necessary for access or maintenance of public drainage facilities.
THEREFORE, BE IT RESOLVED:
THAT, the City of Wilmington hereby authorizes partial release of the public drainage easements, as shown on Exhibit A attached to this resolution, conditional upon completion of relocation of the drainage facilities.
