Title

Resolution Eliminating City Policy 305 “Safety Shoe” and Implementing an Internal Procedure for Providing Eligible Employees with Safety Shoes

Body

LEGISLATIVE INTENT/PURPOSE:

WHEREAS, the City Manager is generally authorized by Sec. 8-1 of the Wilmington City Code (“WCC”) to promulgate and put into effect rules and regulations governing the welfare of City employees; and,

WHEREAS, notwithstanding the City Manager’s general rule-making authority, Sec. 8-1 of the WCC reserves to City Council the authority to change or modify any rules or regulations, or any portions thereof, which govern policies affecting compensation of employees; and,

WHEREAS, this resolution proposes to eliminate Policy 305 “Safety Shoe,” and replace it with an internal procedure that will provide shoes to employees at no cost who work in specific positions that require safety shoes, as defined by North Carolina Occupational Safety and Health (“NCOSH”) regulation 29 CFR 1910.136; and,

WHEREAS, this recommended change affects the compensation of some employees by no longer providing a direct payment of $120 to each eligible employee to purchase safety shoes, and City Council approval is therefore required.

THEREFORE, BE IT RESOLVED:

THAT, Exhibit A, City Policy 305 “Safety Shoe”, is hereby eliminated.

THAT, an internal procedure, as outlined in Exhibit B, is hereby established to provide employees who work in specific positions with safety shoes, as defined by NCOSH regulation 29 CFR 1910.136, on an annual basis.
