Ordinance Reducing the Speed Limit from 35 MPH to 25 MPH Along 47th Street

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, N.C.G.S. ?20-141(b)(1) establishes a 35 MPH speed limit within municipal corporate limits for all vehicles, unless stated otherwise; and,
WHEREAS, N.C.G.S. ?20-141(e) permits Wilmington City Council to assign a lower speed limit on public streets; and,
WHEREAS, N.C.G.S. ?160A-77(b1) authorizes Wilmington City Council to adopt official schedules listing traffic and parking regulations and restrictions that apply to certain streets, parts of streets, and public vehicular areas; and,
WHEREAS, Chapter 5 of the Wilmington City Code provides that certain regulations and restrictions are to be set upon official traffic schedules, as amended from time to time by the City Manager, under the authority of Chapter 5, or by Wilmington City Council; and,
WHEREAS, the City of Wilmington Neighborhood Traffic Program 25 MPH Speed Limit Reduction Request Policy, approved and adopted by Wilmington City Council on September 7, 2021, requires that a Petition for Speed Limit Change be submitted by residents desiring to alter the speed limit within their neighborhood, and such petition be presented to City Council via ordinance for consideration; and,
WHEREAS, the residents and parcel owners along 47th St., within the corporate limits of the City of Wilmington, have demonstrated a consensus to reduce the speed limit on the streets within their neighborhood from 35 MPH to 25 MPH by submitting a Petition for Speed Limit Change, as required in the City of Wilmington Neighborhood Traffic Program 25 MPH Speed Limit Reduction Request Policy.
THEREFORE, BE IT ORDAINED:
Section 1. Article II, ?8(a)(3) of the Official Traffic Schedules of the City of Wilmington is hereby amended by adding the following entry:
"47th St. in its entirety"
