Resolution of Wilmington City Council of Its Intent to Close an Unimproved Portion of an Unnamed Alley Between S. Front Street and S. 2nd Street in the City of Wilmington, North Carolina (SC-1-824)

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, the City Attorney and appropriate members of the City staff have investigated the sufficiency of the requested street closure; and,
WHEREAS, the City Planning Commission has reviewed the application and has forwarded its recommendation on the closing; and,
WHEREAS, City Council is of the opinion that all of the described 99 feet in length unimproved, unnamed alley between S. Front Street and S. 2nd Street in the City of Wilmington, North Carolina, should be closed, and the closing of the same is in the public interest, all in accordance with Section 16.1 of the City Charter, and N.C.G.S. ?160A-299.
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1. The Wilmington City Council intends to close the described unimproved portion of the unnamed alley between S. Front St. and S. 2nd St. in the City of Wilmington, said street being more particularly described as follows:
Beginning at a point in the southern line of an Un-Named Alley, said point being the northwestern corner of the Skyline Realty Inc. tract recorded a book 6609 page 1336 (3rd tract), said point being located S 83-52-33 W 150.55' from a point on the western right of way of S 2nd Street and at the northeastern corner of said Skyline Realty Inc., said northeastern corner being located N 12-34-16 W 298.80' from a concrete control monument at the centerline intersection of S 2nd Street (66' public right of way) and Marstellar Street (66' public right of way): Proceed from said point of beginning S 06?07'27" E a distance of 66.00' to a point; thence S 83?52'33" W a distance of 15.00' to a point; thence S 06?07'27" E a distance of 33.00' to a concrete monument; thence S 83?52'33" W a distance of 15.00' to a point; thence N 06?07'27" W a distance of 33.00' to an exis...
