Ordinance Amending Article 7, Division 3, Section 18-615(B)(1) of the Land Development Code to Change the Membership of the City of Wilmington Board of Adjustment by Adding Two Additional Alternate Members

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, the membership of the City of Wilmington Board of Adjustment (“BOA”) is governed by Article 7, Division 3, Section 18-615 of the City’s Land Development Code, and currently provides that the board shall consist of five members and two alternate members, who shall be residents of the City, and shall be appointed by the City Council; and,
WHEREAS, issues have been brought to the attention of members of Council’s Appointments Committee relating to attendance issues at BOA meetings; and,
WHEREAS, this ordinance is a recommendation from Council’s Appointments Committee to increase the number of alternates on the BOA from two (2) to four (4) in order to address these attendance issues.
NOW, THEREFORE, BE IT ORDAINED:
THAT, Article 7, Division 3, Section 18-615(B)(1), is hereby amended to read as follows:
“1. The board shall consist of five members and four alternate members, who shall be citizens and residents of the city, holding no other public office under the city government, and shall be appointed by the city council.”
THAT, this ordinance shall be effective immediately upon its adoption, and Council’s Appointments Committee shall consider the appointment of the additional two (2) alternates at its next regularly scheduled meeting.
