Resolution Conditionally Releasing Public Drainage Easements Within the Riverlights MX-1 Project (Riverlights Town Center)

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, roadway and drainage facilities were constructed by NNP-IV Cape Fear River, LLC (“NNP-IV”) with the River Road realignment in 2015; and,
WHEREAS, easements for drainage facilities adjacent to the River Road right-of-way were originally recorded at Map Book 61, Pages 201-205 with the New Hanover County Registry, and officially accepted by City Council on April 5, 2016; and,
WHEREAS, the applicant has proposed relocation of drainage facilities within a portion of these easements, and has requested release of the easement in these areas; and,
WHEREAS, once the facilities are relocated and the area has been properly graded and stabilized, staff has determined the portion of the easement requested for release will not be necessary for access or maintenance of public drainage facilities.
THEREFORE, BE IT RESOLVED:
THAT, the City of Wilmington hereby authorizes partial release of the public drainage easement, as shown on Exhibit A, attached to this resolution.
THAT, this release is conditional upon relocation of the drainage facilities (including associated grading and stabilization) within the easement area, per the approved construction plans for the Riverlights MX-1 Mixed Use project, also known as the Riverlights Town Center.
