Attachment #1: Resolution
PURPOSE:
The purpose of this resolution is to authorize the Tax Collector to advertise certain unpaid public nuisance liens, and to file certificates of liens as judgments, for the property located at 715 South 8th Street.
BACKGROUND:
N.C.G.S. ?160A-193 authorizes the City to declare certain conditions on property as public nuisances, and further authorizes the City to remove such conditions, upon the failure of the property owners to do so, with the cost of such removal becoming a lien on the property. Public nuisance liens are collected in the same manner as unpaid taxes. N.C.G.S. ?105-360 and ?105-365.1 authorize the City to collect a tax using foreclosure on or after the date a tax becomes delinquent. N.C.G.S. ?105-375 authorizes the City Tax Collector to foreclose such liens, upon direction of the City Council. The property located at 715 South 8th Street, Wilmington, NC, currently has an outstanding balance with the City of Wilmington for citations and liens stemming from public nuisance violations in the amount of $14,921.29. Additionally, $1,580.39 in delinquent City property tax is owed. The structure located on the property was demolished by the City of Wilmington in 2015, and a lien was placed on the property. Over the years, the property has become a dump site, requiring the City of Wilmington to abate the nuisance and place additional liens on the property. Staff believes that foreclosure is the only mechanism left to the City to be able to stop the current nuisance violations, and to prevent further violations.
