PURPOSE:
Attached for your consideration is a resolution stating that an 11-foot-wide unnamed alley within Seagate Park, which has not been opened and used by the public, is not part of a street plan adopted under N.C.G.S. §136-66.2.
BACKGROUND:
Damon Christopher Tate is the owner of the lots or parcels of land adjacent to an 11-foot-wide unnamed alley that he proposes to withdraw from dedication pursuant to N.C.G.S. §136-96.
The 11-foot-wide unnamed alley has not been opened and used by the public within fifteen (15) years from and after its dedication on the recorded plats, the first of which was dated December 30, 1909, and is recorded in Book 64 Page 465 in the New Hanover County Register of Deeds. N.G.C.S §136-96(e)(2) states that upon request, the City shall adopt a resolution indicating that the dedication described in the proposed declaration of withdrawal is or is not part of the street plan adopted under N.C.G.S. §136-66.2. The property owner has requested such a resolution, and City staff has determined that the unnamed alley is not part of such a street plan.
