PURPOSE:
The purpose of this resolution is to authorize the Mayor to enter into a third amendment to the Interlocal Agreement ("ILA") with New Hanover County related to the creation of the Cape Fear Public Transportation Authority ("CFPTA" or "WAVE" or "Authority"). The amendment would mandate that the two representatives appointed to the Authority board by the City and County be currently sitting elected members of those elected bodies.

BACKGROUND:
On April 7, 2004, and subsequently amended on March 2, 2015, the County and City entered into an ILA to create and fund CFPTA. On February 4, 2020, the City and County entered into a 2nd amendment to the ILA to reorganize CFPTA, including a move from a thirteen (13) member citizen board to a nine (9) member board made up of professional WAVE staff, the Wilmington Metropolitan Planning Organization executive director, ex officio staff from both the City and County, one member appointed by the County, and one member appointed by the City.

At a recent WAVE board meeting, it was requested by the board that the City and County amend the ILA to require the two individual appointees from the City and County to be elected officials of those respective bodies. This resolution is a result of that request, and the County is presenting a similar resolution to the Board of Commissioners this month. The ILA would be amended upon approval of both governing bodies.
