Attachment #1: Ordinance

PURPOSE:
The purpose of this ordinance is to appropriate supplemental funds from the North Carolina Department of Transportation ("NCDOT") to reimburse the City in the amount of $254,000 for pavement resurfacing work on Dawson Street and Wooster Street from 3rd to 17th Streets.

BACKGROUND:
The pavement resurfacing work is occurring in conjunction with the Dawson-Wooster Streetscaping Project ("Project"), which is part of the voter-approved Transportation Bond. The Project consists of adding curb bump-outs, eliminating sidewalk gaps, improving pedestrian access, improving ADA access, and resurfacing of Dawson Street and Wooster Street between 3rd Street and 17th Street. Dawson Street and Wooster Street are owned and maintained by NCDOT, and NCDOT has agreed to reimburse the City for construction costs associated with the pavement resurfacing work.

A construction contract for the Project was awarded by City Council on September 23, 2025. The actual cost of the pavement resurfacing work exceeded the previously agreed upon reimbursable amount of $1,911,000 from NCDOT, which was approved by City Council on April 15, 2025. This supplemental appropriation in the amount of $254,000 will increase the reimbursement amount from NCDOT to the City to match the actual bid cost.

BUDGET IMPACT:
The total reimbursable not to exceed amount from NCDOT, agreed upon by both parties, is $2,165,000, and is to be paid to the City at the completion of the project.
