PURPOSE

The purpose of this ordinance is to appropriate funding to the capital project for Kenan Fountain so that a repair contract can be awarded to fix the fountain and restore fountain operations.

 

BACKGROUND:   

The Kenan Fountain was impacted by a contractor working on behalf of the North Carolina Department of Transportation (NCDOT) while completing street resurfacing work. Damage to the fountain was extensive enough to cause the bowl located on the northeast quadrant to break and no longer contain water. Several other stone pieces were also broken, and the fountain had to be shut down until repairs could be pursued. The City hired an engineering firm to assess the damage and design repairs. The City also filed an insurance claim to recover the cost of the repairs. An initial settlement of $98,571 has been received by the City, but that amount is inadequate to cover the full expense of the repairs, which are now estimated to be $285,500 based on recent bids. City staff is currently pursuing an insurance claim supplement for the difference between the initial settlement and the contract bid price, minus the deductible amount.

 

This ordinance appropriates the amount of the initial claim above, plus an additional $77,693 to cover the cost of the fountain repair contract, with a 10% contingency. Any additional funding received from the supplemental insurance request for the fountain damage claim will remain in a sundry account until long term plans for the fountain are determined.

BUDGET IMPACT:  

$77,693 will be appropriated from Capital Balances interest earnings. The remaining funds for the project will come from insurance claim settlements.
