PURPOSE:
Attached for your consideration is a resolution authorizing the displacement of private solid waste collection services for the Pond Crossing subdivision, consisting of the public streets Plover Court and Eider Lane, within the Wilmington City Limits (see attached Exhibit Map).
BACKGROUND:
On March 18, 2025, City Council voted to officially accept the streets within the Pond Crossing Subdivision as public streets. City code generally requires that solid waste collection be provided by City Recycling & Trash Services (“RTS”) for publicly maintained streets. Within the Pond Crossing subdivision, solid waste collection services are currently being provided by one or more private services. N.C.G.S. §160A-327 governs the displacement of private solid waste collection services by a unit of local government. The City is required to provide public notice of the proposed displacement in the local newspaper and notice via certified mail to the solid waste collection providers (see attached example notice). Staff have communicated with the Pond Crossing homeowners about this displacement. Passage of this resolution and all required private hauler notifications will proceed residents’ notification of an estimated timeline for service transition.
N.C.G.S. §160A-327 also gives the City the option to either provide a 15-month timeline for the private haulers to continue to serve the subdivision or compensate the private hauler an amount equal to 6 months total gross revenues for collection services, which is estimated at approximately $2,100. Since the City initiated the acceptance of the streets because of the Wisteria/Clearbrook Drainage Project, and due to the small number of added service locations, staff recommends compensating the private hauler so the residents will have full access to City recycling, trash, yard waste, and bulky services sooner. Following approval of this resolution, staff estimates that the transition period from private hauler to RTS will take approximately 30 to 60 days. Adding the residents in the Pond Crossing subdivision to RTS will have negligible operational impact, only including 12 new accounts to the current 1,208 stops on Route 204 and more than 33,000 accounts served throughout the City.
budget
BUDGET IMPACT:
None. The approximately $2,100 to be paid to compensate the current private contractor will be paid from existing RTS funds, and that expenses will be offset by fees charged for those services based on the City of Wilmington fee schedule.
