PURPOSE:
The applicant proposes to rezone the site from R-20(L), Residential (Legacy District), to R-7 (CD), Medium-density, Single-dwelling (Conditional District), for a residential development with eight townhome units.
BACKGROUND:
The site includes two lots located adjacent to Motts Creek that are currently developed with two detached single dwellings. The property was annexed into the City in 1995 and assigned the R-20 Residential District zoning classification. The proposed development would replace the existing single dwellings with two four-unit townhome buildings.
The Comprehensive Plan identifies this site as within an Intracoastal Tidewater Area of Opportunity. The plan recognizes the need to increase the housing supply while protecting the natural environment and calls for appropriate transitions between lower-density neighborhoods and more intensive commercial, residential, and mixed-use areas. The plan also prioritizes protecting trees and significant tree clusters as properties are redeveloped.
The proposal provides additional housing that serves as an appropriate transition between existing commercial and residential areas and limits impervious coverage and impacts to protected trees to a greater extent than would be required for a by-right redevelopment of the site under the current zoning.
The Planning Commission held a public hearing on September 2, 2026, regarding this conditional rezoning. One person spoke in support of the request at the public hearing. One written comment was received in opposition, citing concerns with impacts on traffic and services. After discussion, the Planning Commission voted 7-0 to recommend conditional approval of the request.
