PURPOSE:

The proposed amendment would reduce the number of uses permitted by special use permit by allowing some of these uses to be permitted by-right with prescribed conditions and some to be approved by conditional zoning.

BACKGROUND:

The proposed amendment was continued from the June 3, 2025, City Council meeting at the direction of the Council. Based on feedback received from Council on June 3rd, staff revised the proposed amendment to keep special use permits as an option, reduce the number of uses requiring conditional zoning or a special use permit by identifying uses that could potentially be permitted by-right with prescribed conditions, and retaining the special use permit for uses in commercial districts, including community support uses such as group home residential.

The revised proposal was presented to the Planning Commission at their July 16, 2025, meeting, and at a meeting of three Planning Commission members and community stakeholders on June 30, 2025. Based on the feedback received at these meetings, in addition to Council direction, staff made changes, as further laid out in the attached staff report.

Per Council direction, the Planning Commission did not vote on the revised proposal. However, staff notes that two of the three members who initially opposed the amendment continued to express opposition to the revised proposal.
