Attachment #1: Resolution; Attachment #2: 2025 LPA Agreement; Attachment #3: DRAFT Lease - 525 N. Fourth Street; Attachment #4: 1993 LPA Agreement |
PURPOSE:
The purpose of the is resolution is for City Council to adopt a Lead Planning Agency (“LPA”) agreement (“Agreement”) between the City and the Wilmington Urban Area Metropolitan Planning Organization (“WMPO”). The Agreement defines the legal and functional relationships between the and City of WMPO. The agreement is also intended to inform and instruct the officers and staff from both organizations regarding their respective areas of responsibility. As the LPA for the WMPO, the City provides the WMPO with operational space, so this resolution also authorizes the City Manager to execute a lease with the WMPO for the premises located at 525 N. Fourth Street.
BACKGROUND:
The federal government requires regional transportation planning once an urban area exceeds the 50,000-population threshold. To carry out these transportation planning requirements, Metropolitan Planning Organizations are created under 23 U.S. Code § 134. The WMPO was created in the 1970s and was designated as a Transportation Management Area in 2012.
The City of Wilmington has served as the LPA for the WMPO first through the joint City/County Planning Department and then directly as part of the City of Wilmington beginning in 1993. The latest LPA agreement was executed in 1993. Over decades, the WMPO has evolved from a staff position within a City department, to a division within a City department, and now functions as an independent agency.
This agreement establishes the parameters within which the WMPO operates as a governmental unit. The duties and responsibilities of the City and WMPO are articulated within the LPA agreement. The agreement identifies the need for a lease agreement outside of the LPA for the WMPO to occupy the 525 N. Fourth Street City-owned office building. A draft lease is attached to this item, and passage of this item would authorize the City Manager and City Attorney to negotiate any remaining terms of the lease with the WMPO, and authorize the City Manager to execute the lease after an agreement is reached.
