PURPOSE:

The purpose of this resolution is to amend the Military Leave Policy for the City of Wilmington.

BACKGROUND:

The City’s Military Leave Policy ensures the protection of job rights for employees who are absent due to military service, in accordance with the Uniformed Services Employment and Reemployment Rights Act (USERRA). The current policy outlines how employees are compensated during periods of military service or training.

Under the existing policy, employees are eligible for up to 15 scheduled workdays of paid military leave per fiscal year, provided their military pay is less than their regular City salary. Employees must submit documentation of their military earnings to determine any pay differential.

Based on employee feedback and a review of best practices from peer municipalities, staff propose amending the policy to provide up to 15 scheduled workdays of fully paid military leave per fiscal year, regardless of the employee’s military earnings. Additionally, these 15 days will be calculated based on the employee’s regular workday equivalent, recognizing that fire and police personnel work alternative schedules compared to general employees.

BUDGET IMPACT:

There is no direct impact on the City’s budget, as all positions are funded for the entire fiscal year. Indirect costs may arise from overtime incurred to cover duties during an employee's military leave.
