PURPOSE: 

Attached for your consideration is a resolution authorizing the City Attorney to amend a deed for property located at 709 Dawson Street (R05409-025-011-000) to remove a restriction requiring the property to be used as an affordable rental unit in perpetuity.

 

BACKGROUND:   

In 2008, a deed was executed between the City of Wilmington and Wilmington Interfaith Hospitality Network, Inc (now Family Promise of the Lower Cape Fear, Inc., or “Family Promise”) that conveyed the property located at 709 Dawson Street (R05409-025-011-000) (“Property”), subject to a restriction that the Property be used for rental to persons of low and moderate incomes as such persons’ principal residence with no stated period of affordability.

 

A long-time renter of the property inquired about purchasing the home from Family Promise, and in 2026 applied for the City’s Home Ownership Pool (“HOP”) program. This program offers a low-interest mortgage and downpayment assistance to first-time homebuyers and requires a 5-year affordability period.

 

At the May 19, 2026, City Council meeting, Ms. Angie Hill, Executive Director of Family Promise, and Ms. Arleashoan Davis, the current renter and prospective buyer of the Property, spoke during the public information session about their desire to remove the deed restriction to facilitate the purchase and sale of the Property by Ms. Davis. After the two parties spoke, the Mayor directed staff to bring a resolution to the City Council for consideration of the request.

BUDGET IMPACT:  

No previously unallocated budget impacts will be created. The HOP program is funded through the Affordable Housing Fund and the Community Development Block Grant (“CDBG”) program.
