PURPOSE:
The purpose of this resolution is to authorize the City Manager to execute a construction contract change order for the RiverLights Fire Station Project to Samet Corporation in the amount of $250,677 for an equitable adjustment due to extended conditions.
BACKGROUND:
Construction of a new 12,700 SF fire station (“Project”) began in September 2023 on a 3-acre parcel along River Road, which RiverLights Developer NNP IV Cape Fear, LLC dedicated and transferred to the City. The building’s architecture was designed to complement the local neighborhood character and building structures. City staff and its design team worked closely with the developer and residents to ensure the building’s design blended seamlessly with the RiverLights development.
This $7.85M facility includes three (3) truck bays, bunkrooms, a kitchen and dining area, a crew day room, locker/shower/restrooms, an office/radio room, a training room, an exercise room, vehicle and equipment wash-down areas, climate-controlled storage rooms, private vehicle parking space, electric generator space, and additional storage areas. This station was also designed to meet high-performance expectations for new buildings in terms of energy and environmental considerations.
Throughout the duration of the Project, various out-of-scope items beyond the control of the contractor created logistical inefficiencies and slowed the progress of construction. Examples included unexpected third-party utility conflicts in a non-municipal easement, extended coordination with the local developer to obtain utility easements, and various revisions to contract documents. Throughout these issues, the contractor continued to work to push the Project forward in good faith. The City and the contractor reached an agreement to compensate the contractor for a portion of the requested amount, including extended general conditions, site work inefficiencies, extended builder’s risk insurance, and extended equipment warranties. An additional 94 days were added to the contract completion deadline as part of this change order.
The project was successfully completed within budget, and a final certificate of occupancy was issued from New Hanover County on October 8, 2025. A celebratory ribbon cutting event was held on November 1, 2025, to mark the official opening of this state-of-the-art facility.

BUDGET IMPACT:
The agreed compensation is a lump sum price, including all materials, labor, and equipment, excluding profit, totaling $250,677; however, only an appropriation of $66,603 of interest earnings from within the project is necessary to fund this change order.
