Attachment #1:  Ordinance

PURPOSE:

The purpose of this ordinance is to appropriate funds from LIDL US Operations, LLC (“LIDL”) for construction of roadway improvements on Eastwood Road between Town Center Drive and Cavalier Drive.

BACKGROUND:

In a contract executed April 25, 2019, LIDL agreed to lead the design and construction of the City’s proposed roadway improvements between Rogersville Road and Town Center Drive, which were included in phase 2 of the Eastwood Road Access Management project (“Project”) that is a part of the City’s Transportation Bond program. LIDL was to construct these improvements in conjunction with their improvements between Town Center Drive and Cavalier Drive, as required by the City’s development approval for their now constructed store on Eastwood Road. To date, the design of the proposed improvements has been completed, but they have not yet been constructed. LIDL has since approached the City and requested that the City lead the project through construction and receive reimbursement funding from LIDL to cover their proportional share of the project.

budget

BUDGET IMPACT:

Upon execution of an amendment to the current contract, LIDL will be required to contribute their estimated proportionate share of the construction and design costs. LIDL’s estimated contribution is $1,165,000, which includes a contingency. Additionally, LIDL will also be required to deposit 10% of their estimated costs, equaling $116,500, into a contingency account. The City’s estimated costs for this project are approximately $1,300,000. If the cost exceeds the funds deposited, each party shall be obligated to pay their respective proportionate share.
