PURPOSE: 

The applicant proposes to rezone the site (“Property”) from an existing O&I (CD), Office and Institutional (Conditional District), to a new O&I (CD), Office and Institutional (Conditional District), to allow for future mixed-use development.

 

BACKGROUND:   

The Property is included in the Barclay West large-scale mixed-use development. The Property was rezoned on August 6, 2013, from PD (Planned Development) to O&I-1 (Office & Institutional District-1) (CD). Under the current code (effective 12/1/21), the O&I-1 district was reclassified as the O&I district. The conditions applied to the mixed-use development master plan approved in 2013 include a limit to the number of residential units allowed in the areas zoned RB(CD) and O&I(CD) (116 residential units). The proposed rezoning removes this property from the original master plan, including the limit on residential density. The existing density limit will continue to apply to the remaining areas within the Barclay West master-planned development. Two previous rezonings were approved in 2022 and 2023 for the Barclay West development, removing property from the original master-planned conditional district and the residential density cap.

 

The proposed conditional district will prohibit incompatible uses, remove the residential density limit, maintain architectural consistency with current and future phases of the Barclay West development, and set design standards for parking locations, building setbacks, and fenestration. If approved, the density limit on the Property would align with the underlying O&I zoning district at 17 units per acre, with that maximum density eliminated if a workforce housing density bonus is used.

 

The Comprehensive Plan encourages a diverse mix of uses, moderate density, and design that is compatible with the surrounding character, while discouraging strip retail development. Staff believes the proposed conditional district is consistent with the recommendations of the Create Wilmington Comprehensive Plan.

 

The Planning Commission held a public hearing on September 2, 2026, regarding this conditional rezoning. No one spoke in support or opposition to the request at the public hearing. One written comment was received in opposition, citing concerns with impacts on traffic and multi-modal connectivity. After discussion, the Planning Commission voted 7-0 to recommend conditional approval of the request.

Staff recommends approval of the request to rezone the subject property to O&I (CD), subject to the conditions listed in the ordinance and consistent with the Create Wilmington Comprehensive Plan, particularly policies 1.4.1, 1.5.1, 9.1.8, 9.3.2, and 9.4.1.
