PURPOSE:
The purpose of this resolution is authorize the City Manager to enter into a three-year contract renewal with Nseaswim for the year-round management of the Earl Jackson Pool at Northside Park.
BACKGROUND:
Nseaswim is a 501(c)3 nonprofit corporation that aims to increase water safety and prevent drowning in the Wilmington community, and to increase multicultural, ethnic, and socioeconomic diversity in the sport of swimming, with an inclusive environment at all levels of the sport. The facility features a pool dome to operate year-round swim lessons and competitive swim practices.
The City of Wilmington first entered into a pool management agreement with Nseaswim in September 2019 to operate a one-year community outreach pilot for year-round operations at the Earl Jackson Pool at Northside Park. The agreement has been extended multiple times since then, with the current three-year contract term ending June 30, 2026.
Nseaswim has demonstrated itself to be a responsive and professional manager of the Earl Jackson Pool. Under their operation, regular attendance and the number of programs at the pool have increased. This is the only City aquatic facility that operates year-round, an improvement begun by Nseaswim. The pool hosts a diverse population of attendees and promotes aquatic recreation and safety services to traditionally underserved groups.
Previously, the City paid for the pool's utilities. The contract renewal requires the utilities to be transferred to Nseaswim and includes an increase in the contract amount based on projected annual utility costs. Revising management and lease agreements to transfer utility accounts from the City to the manager or lessee with whom the City is contracting has been a strategy the City has pursued over the past few years. The logic behind this change is to encourage the entity operating out of a City facility to engage in energy-efficient or energy-saving activities to help contain rising energy costs.

BUDGET IMPACT:
The contract renewal is recommended to begin on July 1, 2026, through June 30, 2029, a period of 3 years, at $333,344 for FY27, which includes $203,232 for the management of pool operations (an increase of $18,476 over FY26) plus $130,112 for utilities costs.
For fiscal years 2028 and 2029, the contract will be subject to City Council approval during the City’s annual budget process. The payment shall increase from the payment provided for the most recently completed fiscal year by the lesser of the percentage change in the Consumer Price Index for All Urban Consumers (CPI-U) since the beginning of the prior year or 5%.
