PURPOSE

The applicant proposes to rezone the site from O&I, Office and Institutional, district to CB(CD), Community Business (Conditional District), for a Convenience Store and Fuel Station.

 

BACKGROUND:   

The proposed development includes demolishing the existing vacant retail building and constructing a convenience store with fuel pumps. Access to the site is provided by a right-in, right-out driveway and an access easement that connects to University Drive and the signalized intersection on S. College Road. A sidewalk would be required along the S. College Road frontage, and cross-access easements would be provided to adjacent properties located north and south of the site. The proposed redevelopment would reduce on-site impervious coverage and increase connectivity to adjacent properties.

 

The Comprehensive Plan encourages retail, services, and vehicle-oriented development along our major road corridors. The plan calls for infill and redevelopment that improves access to goods and services and increases connectivity to sites along our major roadways. The proposed infill development is consistent with the surrounding area, leverages existing utilities, and introduces additional goods and services. Staff believes the proposed redevelopment is consistent with the desired development pattern along this section of S. College Road.

 

The Planning Commission held a public hearing on July 8, 2026, regarding this conditional rezoning. No one spoke in support or opposition to the request at the public hearing. Two written comments were received in opposition, citing concerns with the proposed connection to University Drive and increased vehicle trips. After discussion, the Commission voted 6-0 to recommend conditional approval of the request.

Staff recommends approval of the request to rezone the subject property to CB(CD), subject to the conditions listed in the ordinance, based on consistency with the Create Wilmington Comprehensive Plan, particularly policies 1.2.1, 1.3.10, 1.7.9, and 1.11.3.
