PURPOSE:

The purpose of this resolution is to award a construction contract to Atlantic Coast Industrial, LLC of Wilmington, North Carolina in the amount of $693,715 for the Downtown Alley Improvements Project (“Project”).

BACKGROUND:

The Project consists of work at Quince Alley and Henderson Alley that includes, but is not limited to, the removal of the existing alley pavement surfaces and their replacement with historic brick pavers, as well as the installation of an underground drainage system to connect to the above-ground building roof drain leaders and air-conditioning condensate lines. The Project also proposes installing conduit for future use in an alley lighting system and undergrounding existing above-ground dry utilities.

The Project was initially advertised for bids beginning on February 12, 2026, with a scheduled bid opening of March 12, 2026. An insufficient number of bids was received at the March 12th bid opening, so the Project was then re-advertised with the additional bid opening scheduled for April 2, 2026. One (1) bid, which exceeded the available Project budget, was received at the April 2, 2026, bid opening. The lone bid received by City staff was presented to City Council at its June 2, 2026, meeting, with a recommendation to reject it because the total bid price exceeded the available funds. City Council reviewed the item and voted to formally reject the bid.

After the bid was rejected, City staff conducted a value engineering review of the Project to analyze ways to bring the Project's projected cost closer to the available budget. After the review, the Project scope was adjusted to reduce estimated construction costs, and a revised bid package was advertised on July 28, 2026. Two (2) bids were received at the September 3, 2026, bid opening, which did not meet the three (3) bid minimum to open bids per N.C.G.S. §143-132. The Project was subsequently re-advertised with a bid opening scheduled for September 17, 2026. Three (3) bids were received at the September 17, 2026 bid opening, with Atlantic Coast Industrial, LLC submitting the low bid in the amount of $693,715.
