Attachment #1:  Resolution

PURPOSE:

The purpose of this resolution is to authorize the City Manager to approve variations to day and time restrictions for alcohol use at the Skyline Center, so long as those variations are consistent with North Carolina General Statutes, and do not materially impact the daily operation of business at the Skyline Center.

BACKGROUND:

Section 6-12 of Chapter 6 of the City Code prohibits the consumption of alcoholic beverages on any property or premises owned or occupied by the City, except as otherwise specifically permitted by City Council. On October 1, 2024, City Council adopted a resolution authorizing the City Manager to draft and implement “Policy 119 - Skyline Center Alcohol Use Policy,” under certain guidelines provided for in the resolution, including day and time restrictions of Monday through Friday from 4:00 pm until 8:00 pm.  During the first few months of implementation of Policy 119, requests have been made that would require staff to come back to Council for approval due to slight variances in days and times allowed for particular functions. Staff is seeking an amendment to allow the City Manager to provide exceptions to the day and time guidelines, so long as any waiver or variance is consistent with North Carolina General Statutes, and does not materially impact the daily business operations of the Skyline Center.

Passage of the resolution would allow minor alterations to the day and time guidelines to be approved internally, and would not affect any other guidelines previously put in place through Council’s October 1, 2024, resolution.
