Resolution to Appoint Councilmember Salette Andrews as One of the City Council Representatives to the Board of Directors for the Cape Fear Public Utility Authority, Replacing Councilmember Charlie Rivenbark, Who Has Exceeded the Allowed Term Limits for Appointment [Sponsored by Councilmember Andrews]

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, on June 19, 2007, the City of Wilmington (“City”) and the County of New Hanover (“County”) approved a joint resolution creating the Cape Fear Public Utility Authority (“CFPUA”), pursuant to N.C.G.S. Chapter 162, Article I; and,
WHEREAS, on July 2, 2007, CFPUA filed Articles of Incorporation (“Incorporation Documents”) with the North Carolina Secretary of State; and,
WHEREAS, Article III of the Incorporation Documents states that the membership of the Board of Directors for CFPUA shall be made up of eleven (11) members, with five (5) appointed by the County, five (5) appointed by the City, and one (1) jointly appointed by both the County and the City, with no more than two (2) members from each body being elected officials; and,
WHEREAS, Section 3.1.1, Article III of the Incorporation Documents states that members appointed by the City and County shall be appointed by those respective governing bodies as a whole, as opposed to by appointment of the Mayor or Chair of the County Commission; and,
WHEREAS, Section 3.2 of Article III of the Incorporation Documents states that each board member shall be appointed to a three (3) year term, with no appointee serving more than three (3) consecutive terms; and,
WHEREAS, it is the intent of City Council that no councilperson appointed by City Council to any board or commission should exceed the allowable term limits set forth by that board or commission; and,
WHEREAS, Councilmember Charlie Rivenbark was initially appointed to the CFPUA Board of Directors by the City in 2009, and has remained on the CFPUA board continuously since that time, resulting in approximately five (5) consecutive terms; and,
WHEREAS, Councilmember Salette Andrews has expressed interest in being appointed to the CFPUA Board of Directors to fill the position currently held by Councilmember Rivenbark, and Councilmember Andrews is otherwise duly qualified to serve as an appointee, following appointment by City Council.
THEREFORE, BE IT RESOLVED:
THAT, Councilmember Salette Andrews is hereby appointed by the Wilmington City Council to the Board of Directors for the Cape Fear Public Utility Authority, to fill the Council appointee position currently held by Councilmember Charlie Rivenbark.
THAT, this resolution is effective July 1, 2024, which shall be considered the first day of an initial three (3) year term.
