PURPOSE:
The applicant proposes to modify an existing R-5(CD) Medium-density Mixed Residential District (Conditional District) to allow for accessory dwelling units.
BACKGROUND:
City Council unanimously approved a conditional district rezoning request from R-15, Residential District to R-5 (CD), Residential Conditional District on August 16, 2005, for a four-lot residential subdivision. Condition #5 of the approval states “Construction on the subject property shall be limited to four (4) single-family detached homes and shall be in conformance with the approved Conditional District Zoning Plan.” Accessory dwelling units (“ADUs") were not considered as part of the previous conditional rezoning request. The applicant has requested a modification of the conditions to allow for the construction of ADUs on the subject properties.
The Comprehensive Plan states that redevelopment should maintain or enhance the desired character of the surrounding area, improve access to goods, services, and amenities, increase housing options, and improve the overall quality of life in the vicinity. The plan also supports accessory housing in association with single-family homes, in new development, and also in existing neighborhoods. The site is located within close proximity to commercial services and employment centers with nearby access to traditional transit services. Commercial uses are generally walkable in this area. The requested change is consistent with the surrounding area, takes advantage of existing utilities, and increases housing options and supply in the area.
The Planning Commission held a public hearing regarding this conditional rezoning on January 8, 2025. One person spoke in opposition and expressed concerns about potential issues regarding short-term rentals. Four written communications regarding the proposed rezoning were received, all of which were in opposition to the proposed change. After discussion, the commission voted 6-0 in favor of recommending approval of the request.
