PURPOSE:
The applicant proposes to modify an existing RB (CD), Regional Business (Conditional District) to allow for additional permitted commercial uses.
BACKGROUND:
On June 21, 2022, City Council rezoned the subject property from R-10, Residential to RB (CD), Regional Business (Conditional District) to authorize an existing nightclub and beauty salon as permitted uses and to allow a retail plant shop as an additional permitted use. The applicant has requested to modify the previously approved conditional district to allow additional commercial uses including restaurant, food catering services, artisan food and beverage production, small-scale general retail, general personal services, offices, studios, performing arts, fine arts, dance, martial arts, and private recreation facility.
The Comprehensive Plan supports compatible infill, neighborhood commerce, and improving access to goods, services, and amenities. The proposed modification would allow for additional neighborhood-scale commercial uses that will improve access to goods, services, and amenities for the area.
The Planning Commission held a public hearing on July 8, 2026, regarding this modification to conditional zoning. No one spoke in support or opposition to the request at the public hearing, and no written comments were received. After discussion, the commission voted 6-0 to recommend conditional approval of the request.

Staff recommends approval of the requested modification of the existing RB (CD), Regional Business (Conditional District) subject to the conditions noted in the ordinance, based on consistency with the Create Wilmington Comprehensive Plan, particularly policies 1.2.1, 1.6.6, 1.7.3, and 1.11.3.
