Attachment #1:  Resolution - Bid Rejection

PURPOSE:

Attached for your consideration is a resolution to reject all bids for the Hooker Road Multi-Use Path (MUP) (U-5534G), Hinton Avenue MUP (U-5534H), and Wrightsville Avenue/Greenville Avenue Intersection Improvements (U-5534C) projects.

BACKGROUND:

The projects are federally funded through the Wilmington Urban Area Metropolitan Planning Organization (“WMPO”) via the Surface Transportation Block Grant - Direct Attributable (“STBG-DA”) program, passing through the NCDOT and requiring a 20% local match from the City. While these projects are individually funded, they are in close geographic proximity to each other and have been combined for the design and construction phases.

The City advertised the Hooker Road MUP (U-5534G) project, combined with the Hinton Avenue MUP (U-5534H) and Wrightsville Avenue/Greenville Avenue Intersection Improvements (U-5534C) projects, for bid on January 30, 2025. A bid opening was scheduled for March 25, 2025, but an insufficient number of bids was received to open, and the projects were re-bid. Bids were opened on April 3, 2025, and one proposal was received, which greatly exceeded the engineer’s estimate and overall budget for the projects. On May 6, 2025, City Council rejected the bid.

The bid documents and cost estimate were revised, and the projects were re-advertised on June 3, 2025. Bids were opened on July 8, 2025, and three bids were received.

Two of the bids received used the incorrect proposal forms from the original advertisement, including the low bidder. It was discovered on July 11, 2025 that City staff had inadvertently sent the low bidder the incorrect bid documents, which caused the bid to be non-responsive. As a result, staff recommends the bids be rejected due to the error by the City, and no contract be awarded at this time. The projects will be re-bid immediately following approval of the rejection of bids by City Council. We anticipate a recommendation for award of a construction contract to be presented to City Council at the September 23, 2025, meeting.
