PURPOSE

Attached for your consideration is a resolution authorizing the official acceptance of right-of-way improvements at two locations at Spicetree Drive and Maple Avenue for ownership, operation, and maintenance by the City.

 

BACKGROUND:   

The projects proposed for acceptance are described below and shown in ‘Exhibit A - Spicetree’ and ‘Exhibit B - Maple.’ Site photos of each location are also attached.

 

The portion of Spicetree Drive proposed for acceptance was constructed in 2005 by Independence South, LLC as part of the Independence South Townhomes project. The roadway connection to the north of this project was accepted by City Council in February 2024. The right-of-way proposed for acceptance within the Independence South Townhomes is identified in ‘Exhibit A - Spicetree,’ which is attached and incorporated by reference to the resolution.

 

The portion of Maple Avenue west of 43rd Street was constructed in 2024 by Storehouse Holdings, LLC. This was a previously existing, unimproved right-of-way that was constructed to facilitate development of the property at 4201 Maple Avenue. The right-of-way and easement proposed for acceptance at Maple Avenue is identified in ‘Exhibit B - Maple,’ which is attached and incorporated by reference to the resolution.

 

Section 18-596.A of the City Code makes provisions for City Council to approve these additions to the City’s infrastructure system upon recommendation by the City Manager.
