Attachment #1: Resolution Attachment #2: Resolution’s Exhibit A Attachment #3: Pond Crossing Subdivision Plat - B34-P94 |
PURPOSE:
The purpose of this resolution is to officially accept public streets and storm drainage facilities within the Pond Crossing subdivision.
BACKGROUND:
The Pond Crossing subdivision received approval from the New Hanover County Planning Department on August 8, 1994, and the subdivision’s map was recorded at the New Hanover County Register of Deeds on August 10, 1994. Pond Crossing subdivision’s streets, Eider Lane and Plover Court, were dedicated for public use at that time, as noted on the subdivision map.
The subdivision streets were not formally accepted by the North Carolina Department of Transportation while the subdivision was in New Hanover County’s jurisdiction. When the subdivision was annexed into the jurisdictional limits of the City of Wilmington some years later, the streets remained dedicated for public use but not accepted into the City’s street system. The Pond Crossing subdivision does not have a homeowner association, and the original developer of the subdivision is no longer operating as a business, per the North Carolina Secretary of State.
The Wisteria/Clearbrook Drainage Improvement Project proposes multiple improvements within the limits of Plover Court’s right-of-way. Specifically, existing drainage infrastructure in the southern cul de sac on Plover Ct have improvements designed as a part of the project. The conditions described above make acquiring an easement from an existing entity associated with the subdivision impractical. The improvements cannot be constructed as proposed without the City’s official acceptance of the streets’ rights-of-way within the Pond Crossing Subdivision.
budget
BUDGET IMPACT:
There is no cost to the City for acceptance of the improvements. However, as a matter of keeping track of the value of City infrastructure, the improvements are valued as follows:
Streets (base, pavements) $58,000
Drainage (pipes, inlets, and manholes) $4,000
Land Value of Rights-of-way (0.84 acres) $182,200
Total Value $244,200
