PURPOSE

Attached for your consideration is a resolution authorizing the official acceptance of right-of-way improvements for ownership, operation, and maintenance by the City.

 

BACKGROUND:   

Swain Way was constructed in 2024 by the NCDOT with the Drysdale Drive Extension project (U-5710A).  The improvements include approximately 0.03 miles of roadway improvements.  The resolution will authorize the City Manager to execute any necessary agreements with NCDOT to facilitate transfer of right of way within the Eastport neighborhood to the City in conjunction with the U-5710A project.

 

Riverlights Del Webb Phases 4 and 5 were constructed in 2020 and 2021 by NNP IV - Cape Fear River, LLC.  The improvements include approximately 1.81 miles of roadway and associated drainage and pedestrian improvements. 

 

The streets and easements proposed for acceptance within Del Webb Phases 4 and 5 are identified in Exhibit ‘A’ and the street proposed for acceptance within the Eastport neighborhood are identified in Exhibit ‘B’ attached hereto and incorporated by reference.  Site photos of each location are attached.

 

Section 18-596.A of the City Code makes provisions for the City Council to approve these additions to the City’s infrastructure system upon recommendation by the City Engineer. The City Engineer has determined that the dedicated improvements and related appurtenances within the public rights-of-way, and within public drainage and sidewalk easements, have been constructed substantially to City standards and in accordance with City requirements, and that it is in the best interest of the City that the improvements be accepted as public.
