PURPOSE:
The applicant is requesting a modification to an existing Special Use Permit ("SUP") for a private recreation facility located at 4950 Holly Tree Road. This item was continued by City Council at the July 21, 2026, meeting to the August 4, 2026, meeting.

BACKGROUND:
On February 4, 2025, City Council approved an SUP for the expansion of an existing private recreation facility, The Club at Midtown (f/k/a Holly Tree Racquet Club, originally constructed circa 1994). The approved SUP includes maintaining two (2) existing tennis courts, replacing eight (8) tennis courts with ten (10) outdoor pickleball courts, constructing a 33,375-square-foot indoor pickleball facility, and renovating a 5,776-square-foot clubhouse. Conditions of the existing SUP include limits on the hours of operation and site lighting, sound-reducing restrictions on the outdoor pickleball facilities, a maximum club membership (800), and a required pedestrian connection to Kirby Smith Drive (south of the site).

On August 5, 2025, City Council approved a Land Development Code ("LDC") amendment that reduced the number of uses required to obtain an SUP by allowing some special uses to be permitted by-right with prescribed conditions and others to be approved by conditional zoning. The subject...
