PURPOSE:
Attached for your consideration is a resolution authorizing the City to enter into an aerial easement agreement with CMT Real Property, LLC, for the installation and maintenance of an aerial conveyor spanning River Road.
BACKGROUND:
The proposed easement will allow the construction of an overhead conveyor structure spanning River Road and supported by foundations located outside the public right-of-way. The conveyor crossing has been engineered to maintain all required roadway clearances and preserve safe vehicular access beneath the structure. The conveyor will be fully enclosed with protective covers to prevent windborne material loss and catch pans will be incorporated beneath the conveyor belt to prevent material from reaching the roadway, railroad, or adjacent areas below.
The proposed conveyor is expected to eliminate more than 20,000 truck crossings of bulk material transferred between the storage facility on the east side of River Road and the marine terminal on the west side of River Road, improving public safety and operational efficiency.
The City is authorized by N.C.G.S. ยง160A-273 to grant easements over, though, under, or across any City property or the right-of-way of any public street or alley that is not a part of the State Highway System. CMT Real Property, LLC has agreed to pay the appraised value ($2,155) to the City as compensation for the approximately 474 square foot easement.
Drawings for the overhead conveyor are shown in Exhibit A attached to this resolution. The proposed aerial easement is shown in Exhibit B.
