PURPOSE: 

Attached for your consideration is a Resolution officially accepting certain easements in the South Oleander and Oleander Estates Subdivisions, pursuant to the attached Drainage Easement Policy approved by City Council on December 14, 2004.

 

BACKGROUND:   

These easements are shown on the attached plats of record at the New Hanover County Register of Deed and were dedicated for drainage purposes. The easement areas on the attached Exhibit A map carry significant amounts of public runoff and are critical to the function of the public drainage system. City staff observed the need for maintenance of the drainage system with the easements, and staff is presenting these easement areas to Council for official acceptance so that maintenance can proceed.

 

Upon approval of this resolution, City staff will continue preparations to maintain these drainage systems. City acceptance will help protect the properties and neighborhoods listed in the resolution and ensure the safe function of the drainage system for these neighborhoods.

BUDGET IMPACT:  

The drainage systems within these easement areas will be maintained by City staff. Valuations for these easements are included in the resolution, in recognition of the asset value added to the City’s stormwater infrastructure, and not as compensation to landowners.
