Resolution Conditionally Releasing Easements Along Raleigh Street

LEGISLATIVE INTENT/PURPOSE:
WHEREAS, street and drainage facilities were constructed along Raleigh Street extension by the North Carolina Department of Transportation (NCDOT) in 2015.
WHEREAS, the Raleigh Street extension and associated easements were officially accepted by the City of Wilmington from the NCDOT at the City Council Meeting on April 5th, 2016.
WHEREAS, the applicant, SHP Wilmington, LLC, is proposing to relocate drainage facilities and has requested release of the drainage easement in these areas in order to accommodate their proposed development.
WHEREAS, once the drainage facilities are relocated, City staff has determined the easements requested for release will not be necessary.
THEREFORE, BE IT RESOLVED:
THAT, the City of Wilmington hereby authorizes release of the public drainage easements as shown on Exhibit A, attached to this resolution, conditional upon relocation of the drainage facilities by SHP Wilmington, LLC. The City Manager is authorized to release the easement upon relocation of the drainage facilities and final inspection by City staff.
