PURPOSE

Attached for your consideration is a resolution authorizing the conditional partial release of public drainage easements within the MX-1 area of RiverLights.

 

BACKGROUND:   

The drainage easements proposed for release are shown in Exhibit A, which is attached to this resolution. These drainage easements were recorded in Map Book 61, Page 203, and accepted by the City Council on April 5, 2016, in conjunction with the official acceptance of River Road. 

 

The release of these easements is conditional and requires the relocation of all drainage facilities (including associated grading and stabilization) within the easement areas, per the approved construction plans for the MX-1 area, now known as the Drift at RiverLights. For historical context, the City Council approved a similar RiverLights conditional release (RiverLights Town Center) at the November 19, 2024, City Council meeting. However, the project associated with the November 2024 action did not move forward. Consequently, the associated easements were not released. If the developer fails to meet the conditions as indicated in the approved construction plans, the easement release will not occur.
